These Terms of Service ("Terms") govern your access to and use of the Pesabits website and application (together, the "Service"), operated by Pesabits ("Pesabits", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. You may not use the Service if you are located in, or are a resident of, a jurisdiction where doing so would be unlawful, or if you are subject to applicable sanctions.
Pesabits is self-custodial. You create a wallet using your Google account or connect an external wallet you already control. You alone hold your private keys and recovery credentials.
The Service provides an interface for funding your wallet with USDC and acquiring exposure to listed companies. We may add, modify, suspend or discontinue any part of the Service at any time. We do not guarantee that the Service will be uninterrupted, timely or error-free.
Nothing in the Service constitutes investment, financial, legal or tax advice, or a recommendation to buy or sell any asset. Content is provided for informational purposes only. You are solely responsible for your own decisions, and you should consider obtaining independent professional advice before investing.
Investing involves risk, including the possible loss of your entire capital. Prices fluctuate and past performance does not indicate future results. Digital assets and blockchain networks carry additional risks, including price volatility, network congestion or failure, smart contract vulnerabilities, and irreversible transactions. You accept these risks when you use the Service.
Fees applicable to the Service are disclosed in the application before you confirm a transaction. Blockchain network fees are set by the relevant network and are not paid to us. We may change our fees on reasonable notice.

The Service may rely on or link to third-party services, including wallet providers, blockchain networks and payment or on-ramp providers. We do not control those services and are not responsible for their availability, content, or acts and omissions. Your use of them is governed by their own terms.
The Service and its content, including our name, logo, designs and software, are owned by Pesabits or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. All rights not expressly granted are reserved.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law, Pesabits and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or assets, arising out of or relating to your use of the Service. This includes losses resulting from your loss of wallet credentials, blockchain network failures, or third-party services.
You agree to indemnify and hold harmless Pesabits from any claims, liabilities, damages and expenses, including reasonable legal fees, arising from your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
We may suspend or terminate your access to the Service at any time if we reasonably believe you have breached these Terms or applicable law, or to protect the Service or other users. You may stop using the Service at any time. Because the Service is self-custodial, your assets remain in your wallet and under your control.
We may update these Terms from time to time. We will revise the "Last updated" date above and, where changes are significant, provide additional notice. Continuing to use the Service after changes take effect means you accept the revised Terms.
These Terms are governed by the laws of the Republic of Kenya, without regard to conflict of law principles. The courts of Kenya will have exclusive jurisdiction over any dispute arising from these Terms, except where mandatory local law provides otherwise.
